近期,部分互聯(lián)網(wǎng)小額貸款機構通過和科技公司合作,以大學校園為目標,通過虛假、誘導性宣傳,發(fā)放互聯(lián)網(wǎng)消費貸款,誘導大學生在互聯(lián)網(wǎng)購物平臺上過度超前消費,導致部分大學生陷入高額貸款陷阱,產生惡劣的社會影響。為盡快規(guī)范整頓大學生互聯(lián)網(wǎng)消費貸款亂象,有必要盡快出臺《通知》,以大學生互聯(lián)網(wǎng)消費貸款業(yè)務為重點,進一步加強放貸機構客戶營銷管理和風險防范要求,加強在校大學生教育、引導和幫扶力度,合理引導網(wǎng)絡輿情,加大違法犯罪行為打擊力度,堅決遏制互聯(lián)網(wǎng)平臺精準“收割”大學生的現(xiàn)象,切實維護學生合法權益。

二、《通知》的主要內容是什么?

《通知》從以下四個方面進一步規(guī)范大學生互聯(lián)網(wǎng)消費貸款監(jiān)督管理工作。一是加強放貸機構大學生互聯(lián)網(wǎng)消費貸款業(yè)務監(jiān)督管理。明確小額貸款公司不得向大學生發(fā)放互聯(lián)網(wǎng)消費貸款,進一步加強消費金融公司、商業(yè)銀行等持牌金融機構大學生互聯(lián)網(wǎng)消費貸款業(yè)務風險管理要求,明確未經監(jiān)管部門批準設立的機構一律不得為大學生提供信貸服務。同時,組織各地部署開展大學生互聯(lián)網(wǎng)消費貸款業(yè)務監(jiān)督檢查和排查整改工作。二是加大對大學生的教育、引導和幫扶力度。從提高大學生金融安全防范意識、完善幫扶救助工作機制、全面引導樹立正確消費觀念、建立日常監(jiān)測機制等方面要求各高校切實擔負起學生管理的主體責任。三是做好輿情疏解引導工作。指導各地做好規(guī)范大學生互聯(lián)網(wǎng)消費貸款監(jiān)督管理政策網(wǎng)上解讀和輿論引導工作。四是加大大學生互聯(lián)網(wǎng)消費貸款業(yè)務中違法犯罪問題查處力度。

三、《通知》對發(fā)放大學生互聯(lián)網(wǎng)消費貸款提出了哪些監(jiān)管要求?

《通知》針對當前大學生互聯(lián)網(wǎng)消費貸款中存在的主要問題,提出了相應的監(jiān)管要求:一是規(guī)范放貸機構及其外包合作機構營銷行為,要求放貸機構實質性審核識別大學生身份和真實貸款用途,不得以大學生為潛在客戶定向營銷,不得采用虛假、引人誤解或者誘導性宣傳等不正當方式誘導大學生超前消費、過度借貸,放貸機構外包合作機構不得向放貸機構推送引流大學生。二是加強銀行業(yè)金融機構大學生互聯(lián)網(wǎng)消費貸款風險管理,針對貸前審核、貸后管理等關鍵環(huán)節(jié)進一步明確風險管理要求,要求嚴格落實大學生第二還款來源,規(guī)范催收行為,加強個人信息保護,所有大學生互聯(lián)網(wǎng)消費貸款信貸信息都要及時、完整、準確報送至金融信用信息基礎數(shù)據(jù)庫。三是部署開展大學生互聯(lián)網(wǎng)消費貸款業(yè)務監(jiān)督檢查和排查整改工作。
